This page sets out the terms that apply when you use this website or purchase work from Anna Hutchinson, together with information about shipping, returns and cancellation, privacy, cookies, and the legal identity of the seller.

Nothing in these terms affects your statutory rights as a consumer.

About the work

The website sells original artworks, limited-edition and other art prints, textile works, and related artwork directly from the studio.

Original artworks are handmade and are individual pieces. Small variations and irregularities are part of the nature of handmade textile and fibre work and are not defects.

I take reasonable care to describe and photograph each work accurately. Colours may appear slightly different depending on your screen, device, or display settings.

Where framing, glazing, dimensions, materials, edition information, or other specifications are important to a particular piece, those details are provided on the relevant product page or elsewhere on the website.

Prices

Prices are shown in euro. Prices include any taxes that I am legally required to charge unless otherwise stated. Delivery charges and any other applicable charges are shown separately before you complete your order.

For deliveries outside the European Union, customs duties, import taxes, handling charges, or similar charges may be imposed by the destination country. These are the responsibility of the customer and are not included in the price charged by me unless expressly stated otherwise.

Orders and payment

Payment is made using the payment methods offered at checkout.

An order is subject to availability. If an item has been sold, incorrectly listed, incorrectly priced, or cannot reasonably be supplied, I will contact you as soon as possible. Where payment has already been taken for an order I cannot fulfil, the relevant amount will be refunded.

The automated order confirmation records the details of your purchase. Please check it carefully and contact me promptly if anything is incorrect.

Original artworks

Original artworks are sold as unique works unless a product description expressly states otherwise.

Purchase of an artwork transfers ownership of the physical artwork only. Copyright and other intellectual property rights in the artwork remain with Anna Hutchinson unless a separate written agreement states otherwise.

Prints and editions

Where a print is sold as part of a limited edition, the edition information stated in the product description applies to that work.

Copyright in the underlying artwork and image remains with Anna Hutchinson.

Commissions and personalised work

Commissioned, personalised, or individually made work will be subject to the specifications agreed with you before the work proceeds.

The normal statutory 14-day cancellation right for distance purchases does not apply to non-prefabricated goods made on the basis of an individual choice or decision by the customer, or goods that are clearly personalised.

This exception does not affect your statutory rights if commissioned or personalised goods are faulty, damaged, or do not conform to what was agreed.

Any additional payment schedule, design approval process, delivery estimate, or other terms specific to a commission will be agreed separately.

Copyright and use of images

All artwork, photographs, text, graphics, and other original content on this website are protected by copyright unless otherwise stated.

Buying an artwork or print does not give you permission to reproduce it commercially, make copies or derivative products from it, licence the image, or otherwise exploit the copyright.

If you would like to use an image of my work for editorial, commercial, licensing, exhibition, or other purposes, please contact me at hello@theannahutchinson.com.

Statutory consumer rights

Goods supplied to consumers must conform to the contract and applicable consumer law.

Nothing on this website, including these Terms & Conditions or the Returns & Cancellation policy below, limits any statutory right or remedy available to you.

Changes to these terms

I may update these terms from time to time. The terms applicable to a purchase are those made available when the order is placed, together with any terms specifically agreed with you.

Governing law

These terms are governed by Irish law.

If you are a consumer living elsewhere, this does not deprive you of any mandatory consumer protection that applies to you under applicable law.

Shipping

 

Dispatch

Orders are normally packed and dispatched within 10 business days of receipt of payment. Unless a different delivery period has been agreed with you, goods will be delivered without undue delay and no later than 30 days after the sales contract is concluded.

If I expect an order to take longer, I will contact you.

Delivery time after dispatch will depend on the destination and postal service and is separate from the studio preparation and dispatch period.

Delivery service

I ship within Ireland and internationally, primarily using An Post.

Artworks are packed carefully for transport. Where appropriate, orders are sent using tracked and insured delivery and tracking information will be provided following dispatch.

I remain responsible for goods until they are delivered to you, or to another person nominated by you to receive them, except where you have independently arranged your own carrier.

If an order is lost or damaged in transit before delivery, please contact me at hello@theannahutchinson.com.

International artwork shipping

Some framed artworks use Artglass.

For certain international shipments, an alternative glazing material may be required in order to reduce the risk of breakage during transport. Where this applies, I will contact you and obtain your agreement to the alternative glazing before dispatch.

Customs and import charges

Orders delivered outside the European Union may be subject to customs duties, import VAT, handling charges, or other local charges.

These charges are determined by the destination country and are the responsibility of the recipient.

Collection

Studio collection may be arranged from Glin, Co. Limerick.

Please contact me after ordering to arrange a suitable collection time.

Delivery delays

If there is an unexpected delay or delivery problem, please contact me.

Your statutory rights in relation to late or failed delivery remain unaffected.

Returns & Cancellation

 

The information in this section applies primarily to consumers purchasing online.

Your right to cancel

For most goods purchased through this website, you have the right to cancel the contract without giving a reason within 14 days of receiving the goods.

If a single order contains several goods delivered separately, the cancellation period begins when you receive the final item from that order.

You must tell me that you are cancelling before the 14-day cancellation period expires.

You may do this by:

  • using the Withdraw from Contract function on this website;

  • emailing hello@theannahutchinson.com; or

  • sending another clear statement that you wish to cancel.

You may also use the model cancellation form below, but you are not required to use it.

If you use the electronic withdrawal function on this website, I will acknowledge receipt of your cancellation electronically.

Returning goods after cancellation

After telling me that you are cancelling, you must send or hand the goods back without undue delay and no later than 14 days after the day on which you informed me of the cancellation.

Please contact hello@theannahutchinson.com for the return address and return arrangements.

Unless I have agreed otherwise, you are responsible for the direct cost of returning goods following a change-of-mind cancellation.

Because artworks can be fragile and valuable, I strongly recommend using appropriate packaging together with tracked and insured delivery.

You are required to take reasonable care of the goods while they are in your possession.

You may inspect the goods in the same way that you reasonably could in a physical shop. You may be responsible for any reduction in value caused by handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.

Original packaging should be reused where reasonably possible because it is designed to protect the artwork during transport. Failure to have the original packaging does not, by itself, remove your statutory cancellation rights.

Refunds following cancellation

When you validly cancel an eligible order, I will reimburse payments received from you for the cancelled goods, including the cost of the least expensive standard delivery method offered for the original order.

If you selected a more expensive delivery service, any additional amount above the standard delivery cost does not have to be reimbursed.

Refunds will be made without undue delay and no later than 14 days after I am informed of your decision to cancel.

For goods being returned, I may withhold reimbursement until either:

  • I receive the goods back; or

  • you provide evidence that you have sent the goods back,

whichever occurs first.

Unless otherwise agreed, reimbursement will be made using the same payment method used for the original transaction, without a refund fee being charged to you.

Items excluded from the change-of-mind cancellation right

The statutory cancellation right does not apply in certain circumstances.

For the work sold through this website, the most relevant exceptions are:

  • commissioned or non-prefabricated works made according to your individual choice or specifications; and

  • goods that are clearly personalised.

An item is not excluded from the statutory cancellation right simply because it was purchased during a sale or at a discounted price.

Faulty, damaged, or incorrect goods

The cancellation rules above are separate from your rights where goods are faulty, damaged, not as described, or otherwise do not conform to the contract.

The exclusions for commissioned or personalised goods do not remove those statutory rights.

If an artwork arrives damaged, is incorrect, or you believe there is another problem with your order, please contact me as soon as possible at hello@theannahutchinson.com and include your order number and photographs where relevant.

Personal information I may collect

Depending on how you use the website, I may collect information including:

Payment information is processed through the payment services made available at checkout. I do not require access to your complete payment-card details in order to fulfil your order.

Why I use your information

Orders and purchases

To place and fulfil an order, I need certain information such as your name, contact details, billing and delivery information. If you do not provide information necessary to process the transaction, I may be unable to accept or fulfil your order.

I use personal information to:

  • process and fulfil orders;

  • take or arrange payment;

  • deliver goods;

  • communicate with you about an order;

  • deal with cancellations, returns, refunds, and complaints; and

  • maintain appropriate transaction records.

The principal lawful bases for this processing are performance of a contract and compliance with legal obligations.

Enquiries and commissions

If you contact me about artwork, a commission, exhibition, collaboration, licensing request, or another enquiry, I use the information you provide to respond to you and manage that correspondence.

Depending on the nature of the enquiry, the lawful basis may be taking steps at your request before entering into a contract, performance of a contract, or my legitimate interest in responding to genuine business enquiries.

Newsletter

If you subscribe to my newsletter, I use your email address and any information you provide for the purpose of sending studio news, exhibition information, new work, and sales or other relevant updates.

The lawful basis is your consent.

You can unsubscribe at any time using the unsubscribe link in an email or by contacting hello@theannahutchinson.com.

Withdrawing consent does not affect the lawfulness of processing that took place before consent was withdrawn.

Website operation, security, and analytics

I may process limited technical information where necessary to operate and secure the website.

Analytics and other non-essential tracking technologies are used only where the required consent has been obtained.

With your consent, I use Google Analytics to understand how visitors use this website, including information about visits, website interactions, device and browser information, and approximate location. Google Analytics is provided by Google. Analytics is used only where the required consent has been obtained through the website's cookie controls.

Who receives your information?

I only share personal information where necessary for running the website, fulfilling orders, providing services, complying with the law, or protecting legitimate legal interests.

Recipients may include:

  • Squarespace, which provides the website, ecommerce, account, form, and related infrastructure;

  • Google, as the provider of Google Analytics, where you have consented to analytics;

  • payment service providers made available through the website;

  • An Post or another delivery provider where necessary to deliver an order;

  • email and newsletter service providers;

  • professional advisers such as an accountant, solicitor, or insurer where necessary; and

  • public authorities where disclosure is required by law.

These providers receive only the information reasonably necessary for the relevant service.

I do not sell your personal information.

International transfers

Some technology, analytics, or payment providers may process personal information outside Ireland or the European Economic Area.

Where personal information is transferred outside the EEA, the transfer will be made in accordance with applicable data protection law, including, where appropriate, an EU adequacy decision or safeguards such as the European Commission's Standard Contractual Clauses. Further information about applicable transfer safeguards can be requested from me.

How long I keep personal information

Personal information is not kept longer than necessary for the purpose for which it was collected, subject to any legal, accounting, tax, insurance, or dispute-resolution requirements.

As a general approach:

  • order, invoice, payment, refund, and accounting records may be retained for up to six years, or longer where required in connection with an ongoing legal or tax matter;

  • enquiry correspondence that does not lead to a transaction is normally deleted when it is no longer reasonably required, with periodic review;

  • commission and contractual correspondence may be retained with the associated transaction record;

  • newsletter information is retained until you unsubscribe or the mailing list is otherwise cleared;

  • customer-account information is retained while the account remains active and thereafter only for as long as reasonably necessary; and

  • cookie information is retained according to the periods described in the Cookie Policy.

Your data protection rights

Depending on the circumstances, you may have the right to:

  • access personal data held about you;

  • have inaccurate information corrected;

  • request deletion of personal data;

  • request restriction of processing;

  • receive certain personal data in a portable format;

  • object to certain processing; and

  • withdraw consent where processing is based on consent.

These rights are subject to the conditions and exemptions provided by data protection law.
